Alcohol abuse and protection of minors

Pursuant to Article L. 3342-1 of the Public Health Code prohibiting the sale of alcohol to minors under eighteen (18) years of age, the customer undertakes by validating his order to be eighteen years old on the date of the order.

ARTICLE 1: APPLICATION OF THE GENERAL TERMS AND CONDITIONS OF SALE (GTS)

These General Terms and Conditions of Sale govern the sale of products on the site merchant of the Eurl La Boutique Aleria.

They are available to the buyer on the order page.

Any possible modification of the GTS will only apply to sales concluded after the modification, the dates appearing on the acknowledgment of receipt of the order addressed to the buyer being authentic.

The site’s offers are exclusively reserved for private and professional customers, excluding all shops and supermarkets (hypermarkets, supermarkets, etc.). La Cave d’Aléria reserves the right, for any new customer, to request a piece proof of identity and domicile before the final validation of his first order.

ARTICLE 2: PRICES

Our selling prices are those indicated on the site when ordering. The electronic catalogue is regularly updated.

We reserve the right to change our prices at any time according to promotions, variations in raw materials, prices of our suppliers or due to possible typographical errors in the display of these same prices. Prices are inclusive of VAT, in euros. Shipping costs are extra. They vary according to the quantities ordered. The amount of the shipping costs is displayed when entering the order.

ARTICLE 3: CONTENT OF THE ORDER

The order must strictly comply with the offer as issued on the site and in particular the formats, quantities offered and deadlines.

ARTICLE 4: ORDER STEPS

The order presupposes the prior knowledge by the customer of these conditions, the price, and the essential characteristics of the chosen wines, available on the site.

The order is taken via the “Basket” (dematerialized order form) accessible online on the Cave d’Aléria website.

The buyer communicates the requested information, necessary for the realization of the order. He takes care on this occasion not to omit any information essential to the proper execution of the delivery:

Precise delivery information (delivery address different from the billing address, telephone number during the day, possible access code to the residence, intercom code …)

The buyer is identified by means of his e-mail address.

The buyer accepts the order by clicking on “validate” after choosing the terms of his payment and entering the requested indications to allow it in the areas provided for this purpose. Its acceptance is then final, subject only to the possible exercise of its right of withdrawal described below.

ARTICLE 5: DATE OF SETTLEMENT

Any order of wine and accessories can only be validated if it is accompanied by the payment of the full price T.T.C.

ARTICLE 6: METHODS OF PAYMENT

By credit card, in euros, (Carte Blue, Visa Card, Eurocard/Mastercard) indicating in the area provided for this purpose (secure online payment via PayPal) the number of your card, without spaces between the digits, as well as its validity date and the three-digit security number on the back of your card. Banking information is encrypted and impossible to decode. The Eurl La Boutique Aleria does not have access to your credit card information, only the e-mail accusing the proper execution of your payment reaches us.

ARTICLE 7: TRANSFER OF OWNERSHIP

La Cave d’Aléria reserves ownership of the goods sold until their payment by the buyer (Law No. 80-335 of 12 May 1980).

ARTICLE 8: AVAILABILITY OF GOODS

Offers are always made subject to the quantities available. In case of unavailability of the wines ordered and subsequent cancellation of the order, the price will be refunded to the buyer as soon as possible.

ARTICLE 9: DESTRUCTION

In case of destruction of the goods before the date scheduled for the delivery of the order, in the absence of stock available to proceed with its replacement, the buyer will be refunded the sums paid by him, to the exclusion of any other compensation, within 30 days of the date of the disaster.

ARTICLE 10: DELIVERY

The standard indicative delivery time is 7 working days following the day of processing of the validated order (the processing of the order is carried out within 48 hours of the validation of the latter), from Monday to Friday, between 9 am and 6 pm, except in exceptional circumstances.

If exceptionally the buyer should note the absence of delivery within the deadlines indicated above, he should immediately notify La Cave d’Aléria to allow them to remedy the problem as soon as possible, the execution of the order must then take place at the latest within 30 days.

The presentation of the goods at the place and date indicated by the buyer releases the seller from his obligation of delivery.

In case of absence of the buyer during the presentation of the goods, as far as possible and according to the circumstances, the road carrier will contact the buyer for a second delivery, provided however that the latter has communicated a telephone number where he will be reachable at any time for the proper execution of the delivery.

The buyer is obliged to check the condition of the packaging as well as the contents of the package(s) upon delivery.

In the event of damage or lack of conformity, the buyer is imperatively required to express reservations on the delivery note, specifying the anomalies found, and to notify La Cave d’Aléria within 48 hours of receipt of the wines. If a breakage is noted, the buyer must refuse the damaged package, indicate it on the delivery note of the carrier and inform La Cave d’Aléria.

ARTICLE 11: RIGHT OF WITHDRAWAL

A right of withdrawal is offered to the buyer under Article L.121-20 of the Consumer Code.

Upon receipt of the goods, the buyer has a period of 14 clear days to return the product La Cave d’Aléria and request a refund.

Where the seven-day period expires on a Saturday, Sunday or a public holiday or non-working day, it shall be extended until the first following working day.

Products damaged after delivery will not be taken back.

The buyer who uses this option will have the obligation to proceed, under his responsibility and at his expense, to the return of the goods ordered in the cellars of the seller.

When the goods have been sold in a promotional lot, the entirety of it must be returned To La Cave d’Aléria due to the indivisibility of the order and the overall price invoiced. The buyer’s refund will be made within 30 days of the return.

ARTICLE 12: QUALITY OF WINES

The Cave d’Aléria cannot be held responsible for any quality damage caused by the transport of the wine.

ARTICLE 13: FORCE MAJEURE

The Cave d’Aléria cannot be held responsible for loss, damage, or failure to deliver an order, resulting from a case of force majeure (such as natural disasters, strikes, road accidents) these cases are in addition to those usually retained by French jurisprudence.

ARTICLE 14: ATTRIBUTION OF COMPETENCE

La Cave d’Aléria Customer Service is at your disposal to settle everything amicably problem following an order and its execution. In case of impossibility to reach an agreement, all conflicts arising from the execution of an order or the interpretation of these conditions, and more generally agreements of any kind concluded between the parties, will be attributed to the court of the seat of La Cave d’Aléria.

ARTICLE 15: ARCHIVING

Article L.134-2 of the Consumer Code: it is up to La Cave d’Aléria to keep for 10 years from the delivery of the goods, the writing stating the contract concluded electronically, if this contract relates to a sum greater than 120 euros.
